this guy says he has 2 kids, the girl friend has lived in spain 4 years and they have a family book yet they are not married at all, can he actually get a family residency, anyone know?

1. If you are interested in this guy,you should be running because this sounds like trouble. 2. I am sorry but the question is sketchy, what does the family book have to do with anything? 3. This is his problem, you should let him deal with it figuring out his residency. If the children were born in the states, then that is where there residence should be but it all depends on if the mother took them to Spain with or without permission. 4. He still a father with legal rights. this doesn't mean that he needs to get residency out of the country to still see his children.

No. He can't get residency through his girlfriend and his children. The only way to do so is if he marries the girlfriend and/or if he gets a job in Spain to justify residency.

the two answers here are totally wrong and misleading Yes you can get a residency if you have children in any country, even a citizenship in the USA for just that of all countries. here is how it works, the father is in the family book along with the mother once a child is born, they both have rights to reside in Spain to support the kids Family members of EU citizens The rights of the EU citizen are extended to their family members (irrespective of nationality). This includes the spouse by marriage, a partner by civil partnership (or marriage equivalent), dependent children under 21 and dependent grown children and parents. Application should be made for a Residency Card for EU Citizen Family Members (Tarjeta de residencia de familiar de ciudadano de la Unión) at the Foreigner's Office (Oficina de Extranjeros) or local police station in the province of intended residence. The following documents are required in order to apply for a Residency Card for EU Citizen Family Members (others may also be requested): * Valid passport (or a copy of a renewal application) * Signed application form EX16 (Solicitud de certificado de registro como residente o Tarjeta de residencia de familiar de ciudadano de la Union) o To download the form EX16: Click here * Proof of family relationship with the EU citizen (such as a marriage certificate, proof of partnernership registration, birth certificates for children) * Identification (passport) or DNI (Spanish citizen) of the EU family member * Three recent colour passport photographs
